Welcome to Trustiew LTD ("Trustiew," "we," "us," or "our"). By using our platform (the "Service"), you ("User," "you," or "your") agree to comply with and be bound by the following Terms and Conditions. Please review them carefully before subscribing to our services. If you do not agree with any part of these Terms, please refrain from using our Service.

1. Services Overview
Trustiew is a software-as-a-service (SaaS) platform designed to provide lead information to software development agencies. Leads are generated when clients calculate estimated project costs for mobile and web application development via our proprietary price calculation system.

2. Subscription Plans
We offer three subscription plans:

Startup Plan: $149/month, 5 leads per month with budgets up to €15,000.
Growth Plan: $249/month, 10 leads per month with budgets up to €25,000.
Enterprise Plan: $600/month, 30 leads per month with budgets up to €60,000.
Subscription plans are billed monthly, and each subscription plan requires a 12-month minimum commitment. By subscribing, you agree to this 12-month commitment period starting from your subscription date.

Renewal and Termination
After the 12-month period, subscriptions will renew on a monthly basis unless canceled at least 30 days before the renewal date.
If a User chooses to cancel before the initial 12-month term, no refunds or partial refunds will be issued for any prepaid amounts.

Refund and Cancellation Policy
All subscriptions are final and non-refundable after payment has been processed. Early cancellation will not result in any refund, and Users will be responsible for completing payments for the full 12-month commitment.

3. Payment Terms
All payments are due on the first day of each billing cycle, and all subscription fees are non-refundable, except as may be explicitly provided under applicable law. Failure to pay subscription fees will result in suspension or termination of access to the Service.

4. Lead Quality and Limitations
While Trustiew makes efforts to ensure lead quality, we do not guarantee the quality, accuracy, or authenticity of any leads provided. Leads are based on users who have calculated a price for app development via our system, but:

We cannot guarantee they are actual clients or that they have real intent to proceed with a project.
Leads may include users who used the price calculator out of interest or curiosity.
By accepting and using the leads, you agree that Trustiew shall not be held liable for any potential inaccuracies, errors, or unsuccessful outcomes from any lead. Trustiew provides no warranty on lead conversion or success rates and disclaims all responsibility for User outcomes.

No Warranty for Lead Conversion
Trustiew provides leads based on interest shown by users in calculating project estimates but does not warrant that these leads will result in business, successful conversions, or any financial gain. Users accept all risks associated with contacting or following up with leads.

5. No Resale or Redistribution
All leads provided through your subscription are for your direct use only. Reselling, sharing, or redistributing leads provided by Trustiew is strictly prohibited. Violation of this term may result in immediate termination of your subscription without refund and may subject you to additional legal action.

6. Data Usage and Privacy
When you register on Trustiew, you consent to Trustiew’s use of the data you provide, including but not limited to your company logo, name, company size, and email, for marketing purposes. Your personal information will be processed in accordance with our Privacy Policy, which explains how we collect, use, and protect your personal information.

Data Protection and GDPR Compliance
Trustiew complies with the General Data Protection Regulation (GDPR) with respect to any personal data processed. By using the Service, you acknowledge that you have reviewed and agree to our data processing practices as outlined in our Privacy Policy.

7. Intellectual Property Rights
All intellectual property on the platform, including software, design, content, and trademarks, is owned by or licensed to Trustiew. You may not reproduce, distribute, or create derivative works of our intellectual property without explicit written permission from Trustiew.

8. Account Registration and Security
Each User is responsible for maintaining the confidentiality of their account and password and for restricting access to their computer. Users agree to accept responsibility for all activities that occur under their account.

9. Eligibility and Compliance
By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this agreement. You agree to comply with all applicable laws and regulations in connection with your use of the Service.

10. User Conduct

By using Trustiew, you agree:

Not to use the platform in any way that violates any applicable law or regulation.
Not to engage in unauthorized or automated access to our systems, including by bots, scraping, or similar methods.

To maintain the confidentiality of any leads and not to misrepresent yourself or your company when contacting leads.

11. Suspension and Termination of Service
Trustiew reserves the right to suspend or terminate your access to the Service, with or without notice, if we suspect or determine that you have violated these Terms, failed to pay subscription fees, or otherwise engaged in conduct harmful to Trustiew or other Users.

12. Indemnification
You agree to indemnify, defend, and hold harmless Trustiew, its affiliates, officers, directors, employees, agents, and partners from any and all claims, damages, losses, liabilities, costs, and expenses (including attorney's fees) arising from or related to your use of the Service, violation of these Terms, or violation of any rights of another.

13. Limitation of Liability
Trustiew will not be liable for any direct, indirect, incidental, consequential, or punitive damages, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses arising out of or related to your use of the Service. The maximum liability of Trustiew to any user, under any circumstances, shall not exceed the total amount paid by you to Trustiew over the previous six (6) months.

14. Disclaimer of Warranties
Trustiew provides the Service on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding the quality, accuracy, or availability of the Service or any leads provided. Trustiew disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

15. Third-Party Integrations and Links
The Service may include links or integrations with third-party websites or services, which are provided for convenience. Trustiew does not control these third parties and disclaims any liability arising from their content or practices.

16. Limitation on Lead Access or Plan Modifications
Trustiew reserves the right to limit, modify, or adjust lead allocations and plan features based on lead availability or platform demands. Subscribers will be notified of any changes impacting their plan features or lead allocation in advance.

17. Changes to Terms and Conditions
Trustiew reserves the right to update or modify these Terms and Conditions at any time. We will notify users of material changes to the Terms through email or the platform. Your continued use of the Service after any modifications to the Terms constitutes your acceptance of the updated Terms.

18. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of United Kingdom. You agree to submit to the exclusive jurisdiction of the courts located within London for any disputes arising out of or relating to these Terms or your use of the Service.

19. Entire Agreement
These Terms and Conditions, along with our Privacy Policy, constitute the entire agreement between you and Trustiew regarding your use of the Service and supersede any prior agreements or understandings, whether written or oral.
